Northland announces lawsuit spree for New Year PDF Print

Shareholders of Northland City have gone on a suing spree slapping legal claims on almost every persona who has been in contact with the project one way or the other. These include the Roads Contractor Company (RCC), the Legal Assistance Centre, the Ministry of Trade and Industry, and the Helao Nafidi Town Council.

The RCC is the first in line with a lawsuit of N$36 million. In an unsigned statement, the Board of Directors of Northland said it is suing RCC “for breach of agreement.” The board said it has been in consultations with its lawyers for months before it decided to sue RCC.

RCC chief spokesperson, Gernot de Klerk, said the company hase received the summons. “But we believe this action to be frivolous and hence will be defending it vigorously,” he said.

De Klerk said RCC only signed a memorandum of understanding and a cooperation agreement with Northland but later decided to put its “participation on hold until such time as the apparent differences amongst the directors have been resolved.”

Northland said “the RCC legal claim is only the first of many in what will be a costly multi-front legal offence.”

“The company has resolved to launch legal damage claims against other parties involved in interfering with the company's internal affairs,” read the statement.

Among those in line to be sued is the Ministry of Trade and Industry with the Registrar of Companies, a Mr Andima, as the co-defendant. In August this year Northland City's then owner, Tony Mbok, claimed that the ministry, especially the Registrar of Companies, acted unethically by refusing to allow changes to be effected to company documents. Shapua Kaukungua, a former shareholder, is alleged to have lied to the Registrar of Companies that State House had given instructed that no changes be made in the company register.

The Helao Nafidi Town Council and its management are also on the suing list. The town council is alleged to have delayed the project and misappropriating funds meant for the resettlement of the villagers. Ironically the board of Northland say it has also resolve to sue the Legal Assistance Centre for “public defamation.”

Former shareholders of Northland are also being sued for “being involved in a copy cat project in the Helao Nafidi town called Northgate.”

Unspecified consultants will also be sued for “unethical business practices involving dissemination of proprietary information and breach of client trust.”

The permanent secretary of the Ministry of Trade and Industry, Andrew Ndishishi, said the ministry is still to receive the summons.

The CEO of Helao Nafidi, Christian Shivolo, declined to comment.
